Mesothelioma: A Full Spectrum Examination

Receiving much press in recent years ~ both because of the number of people affected, as well as the sometimes sensational, multi-million-dollar lawsuits that have been filed, fought, won & lost ~ is a rare form of cancer known as malignant mesothelioma, whose principle cause is exposure to aspestos fibers.

Asbestos, a known toxin since the 1930's, is an inexpensive fibrous material that is extremely durable and heat resistant. Because of these properties it was, for many years, heavily used in industry throughout the United States. Even after its carcinogenic (cancer-causing) properties were discovered, many industries continued to use asbestos, putting at risk those who were exposed to it. Asbestos-containing products remain, to this day, in buildings, ships, industrial facilities and other environments. The EPA has stated that asbestos "presents an unreasonable risk of injury to human health." Even low levels of asbestos exposure can trigger not only mesothelioma, but also asbestosis, pleural disease and lung cancer: diseases that are caused almost exclusively by asbestos. The statistics for recent years show an average of 3000 people per year dying of aspestos-related causes.

Because aspestos products have been used so heavily by industry, many people have come into contact with asbestos fibers via their jobs (e.g. via occupational exposure). There is also a risk to the family members of those working in at-risk occupations; this exposure is called paraoccupational exposure. People who live near sites that have asbestos around the facility are also at risk. Refineries, power plants, factories, shipyards, steel mills and building demolition are types of work sites that can release asbestos fibers into the environment and contaminate nearby residential neighborhoods. Mesothelioma can result from very small fibers or dust particles at low exposure levels. (Most such exposure would likely have occurred prior to 1973, but the latency period can be up to 40 years for most types of lung cancer to develop.) Trades in which aspestos exposure is likely include:

~ Asbestos product manufacturing (insulation, roofing, building, materials)

~ Automotive repair (brakes & clutches)

~ Construction/contractors

~ Maritime

~ Miners

~ Offshore rust removals

~ Oil refineries

~ Power plants

~ Railroads

~ Sand or abrasive manufacturers

Malignant mesothelioma is the formal medical name for this form of lung cancer. (A lay term for the equivalent condition is Aspestos Cancer). Mesothelioma is the term used to describe a cancerous tumor which involves the mesothelial cells of an organ, usually the lungs, heart or abdominal organs. Malignant Pleural Mesothelioma or cancer of the lung lining is the most common form of mesothelioma cancer. Peritoneal Mesothelioma is cancer of the stomach lining and is the next most common form.

The onset of mesothelioma asbestos lung cancer is usually very slow: the time between aspestos exposure and the onset of symptoms can be many years. The most common mesothelioma symptoms are chest pain and pain in the lower back. Sometimes the pain is accompanied by difficulty breathing, coughing, weight loss and fever.

Symptoms for Pleural Mesothelioma (involving the lung / chest area) are:

~ chest pain and pain in the lower back

~ difficulty breathing

~ coughing

~ weight loss

~ fever

~ muscle weakness and sensory loss

~ swelling of the face and arms

~ hoarseness

~ coughing up blood

Symptoms of Peritoneal Mesothelioma (involving the abdominal / stomach cavity, liver, spleen or the bowel) are:

~ abdominal bloating due to fluid accumulation in the abdominal cavity

~ nausea & vomiting

~ swelling of the feet

~ fever

~ impaired bowel function

Diagnosing mesothelioma (within the framework of western medicine) can be challenging, because the symptoms are quite similar to those of other illnesses and conditions. A western medical diagnosis of mesothelioma might include any or all of the following: a review of the patients medical history and asbestos exposure; a complete physical examination, with x-rays of the chest or abdomen and lung function test; a CAT scan or MRI of the chest or abdomen; a biopsy.

In the case of pleural mesothelioma, a thoracoscopy may be performed where the doctor looks inside the chest cavity with an instrument called a thoracoscope that is put into the chest between two ribs. The thoracoscope allows the doctor to gather tissue samples and look inside the chest. For cancer in the abdomen (peritoneal mesothelioma), a western MD may perform a peritoneoscopy where a small opening is made in the abdomen and an instrument called a peritoneoscope is inserted in the abdomen cavity to collect tissue.

If mesothelioma is indeed diagnosed, the next step will be to determine the stage of the disease. The staging process helps to determine which part of the body the cancer has spread to, which in turn dictates a treatment plan. If the cancer is found only on the membrane surface where it originated it is called localized. If the has spread beyond the original membrane surface to other parts of the body it is called advanced.

Western Medical Treatment Options (chosen in accordance with the age and/or health of the patient) include surgery, radiation therapy, and/or chemotherapy. Surgery ~ during which part of the lining of the chest or abdomen may be removed ~ is a common treatment option for mesothelioma. For pleural mesothelioma, either a full lung or the muscle below the lungs that help with breathing (the diaphragm) may be removed. Radiation therapy uses high-energy rays to kill cancer cells and shrink tumors. This type of therapy only affects the cancer cells in the treated area. Chemotherapy uses anticancer drugs to kill cancer cells throughout the body. The drugs used to treat mesothelioma are sometimes given by injection in a vein. Along with surgery and radiation, using a needle or thin tube to drain fluid that has built up in the chest or abdomen is one way to relieve some of the symptoms and control the pain associated with this condition. In addition, medications may be given through a tube in the chest to prevent fluid from accumulating and, once again, reducing some of the more painful symptoms.

The physical and psychological strain of malignant mesothelioma can be severe, and western medical treatments meant to heal often cause unexpected and irritating side effects. For these reasons, it is important for the mesothelioma patient to gather as much information as possible about how malignant mesothelioma progresses as a disease, as well as to explore alternative or complementary treatment options (see below). And if a western treatment is chosen as part of the healing protocol, its important to know what side effects to expect and how to minimize them.

Along with managing the disease itself, Mesothelioma patients oftentimes find themselves embroiled in legal battles (reminiscent of the Karen Silkwood case) ~ in class-action or individual lawsuits against the companies or corporations by whom they were employed at the time of their exposure to aspestos. Aspestos Law has emerged as a specialty, with mesothelioma attorneys and lawyers positioned to support their clients in establishing a link between a specific aspestos exposure and their subsequent contracting of mesothelioma and ~ to the extent that they are successful ~ taking, in the process, a handsome cut of the settlements.

Because of the physical, emotional, psychological & spiritual (as well as legal!) challenges involved with a disease such as mesothelioma, creating a strong support system is a vital part of the healing process. As has been documented from the experiences of many with so-called terminal illnesses, the introspection that arises in the face of such a challenge oftentimes has the hidden benefit of allowing what is really important to emerge. For this to happen, however, requires the creation of an (internal & external) environment conducive to such explorations. And what are the building blocks to creating such supportive (non-toxic!) environments?

Everyone can improve their energy level and promote healthy cell growth by getting adequate rest and relaxation, good nutrition, some exercise and having some fun! Here are some practices commonly recommended for cancer patients:

~ Learn relaxation techniques (yoga or qigong are an excellent choice)

~ Share your feelings honestly with family, friends, a spiritual advisor or a counselor

~ Keep a journal to help organize your thoughts

~ Find a source of spiritual strength

~ Pray or meditate

~ Find time to be alone

~ Go for walks

~ Remain involved with work and leisure activities to the extent possible

~ find a support group or chat room to share your experiences with others in a similar situation

~ as much as possible, maintain a positive attitude, and optimistic outlook

Of the many alternatives or compliments to western medical treatment, qigong is one that stands out as particularly hopeful. In China, there are entire hospitals devoted to the use of qigong techniques exclusively, for the treatment of cancer as well as countless other conditions. Binhui He is one Medical Qigong Master (http://www.wishus.org/research.asp?cat=research&index=2) who has had large success working with cancer patients. His qigong anti-cancer therapy protocol includes, in his own words, the following five steps:

~ Attitude change: Turn traditional searching help outside into searching help inside. It is the immune function and self-healing power that cure cancer eventually! While fear-of-cancer effect is the real incurable disease, since it keeps patient stressed and lowers their immune functions. Instead, consider cancer part of the body, communicate with it by consciousness power, and eliminate the source leading to cancer in the first place.

~ Intensive Qigong practice: empty mind without desire, forget about disease, trouble, environment and self; rapidly stimulate immune functions and body potential by intensive Qi cultivation.

~ Energetic Fasting (Bigu): Cut the supply for tumors so as to inhibit the rapid growth of cancer; and help to strengthen immune function effectively (Need under the close supervision of an experienced Qigong healer).

~ Shatter Tumor by Strong Qi: Focus of mind power and strong Qi can shatter after a period of Bigu.

~ Collective Qi Adjustment: Group practice of Five-Element Qigong to form a strong Qi field and to strengthen the inhibitory effect of the Qi cultivation.

In the United State, Dr. Kam Yuen (http://www.yuenmethod.com) is a 35th-generation Shaolin Master who has created a healing system which combines the power of qigong practice with the diagnostic techniques of applied kinesiology. He, also, has had great success working with a whole variety of conditions, including cancer.

Similar in many ways to Taoist qigong practices are the Tibetan practices described in Tulku Thondups two books: Boundless Healing: Meditation Exercises To Enlighten The Mind & Heal The Body; and The Healing Power Of Mind. The specifics of the practices vary widely, though what many have in common is the use of an internally-cultivated energy of blissful heat to resolve whatever imbalances are at the root of the condition. He presents, in these two books, a number of practices designed specifically for those working with cancer. Tulku Thondup also travels quite widely, offering workshops & retreats in which he presents these Tibetan healing techniques.

Chinese Medicine offers yet another paradigm through which to examine mesothelioma. The diagnostic system of Chinese Medicine is quite dramatically different from that of western medicine. If in fact we were to present to the Chinese physician, say, ten people who had all received the western medical diagnosis mesothelioma, it is entirely possible that this Chinese physician would ~ after his or her examinations ~ present us with a different diagnosis for each of those ten people! (The reasons for this are complex, and beyond the scope of this essay, but the basic reason is because Chinese medical perception looks at patterns present within the entire person, and in relation to every aspect of their lives; while western medicine tends to focus primarily on individual symptomotology.)

In Chinese Medicine it is understood that emotional imbalance is often a root cause of physical imbalance. The emotional state that damages the lungs (and its corresponding physical structures, which include the skin & mesothelial cells), and which also tends to appear when the lungs are out of balance, is grief. The emotional state which signals a balanced, healthy lung organ system is courage. There is also a belief, in Taoist philosophy (the root of Chinese Medicine), that the lungs are the equivalent in the human body to the atmosphere/ionosphere of the Earth. So an aspect of Chinese Medical treatment for a lung imbalance of any sort might well be to do practices to release (individual & planetary) grief ~ e.g. a healing sounds qigong practice ~ and to augment our feelings of courage and righteousness: our willingness and capacity to stand up strongly for Truth, for Beauty, for Love, for Kindness or whatever other values we hold most deeply, for ourselves, our communities and our planet.

Remembering A Special Fourth Of July!

The evening sun was a burnt orange ball sliding beneath the horizon on Pensacola Bay. Various aromas of hamburgers, smoked sausages, boiled corn and barbequed ribs filled the park. Just across the street in the bay, a barge was anchored in the water which would provide fireworks for the night. Even an occasional whiff of sweat and suntan oil from hundreds of mingled bodies simmering in the late afternoon evening sun added to the anticipation of tonight's program.

Home of the Pensacola Naval Air Station, there was very little standing room as the huge crowd listened to local and military dignitaries give mini-speeches about America and the sacrifices our young men and women had undergone in order to maintain Kuwait's freedom and ultimately our own.

This Fourth of July celebration was a short time after the last gulf war; the one that officially lasted only a few days. The USS Saratoga had recently come home to a hero's welcome! My son, a naval corpsman was one of those who had been on the ground in Saudi and Kuwait for almost a year. The Navy and the city of Pensacola were going all out on this Independence Day weekend! It was an experience I recall every year about this time, and hope that I'll be able to experience that same sense of unbridled patriotism that was so apparent that holiday weekend over a decade ago.

The event was held in Pensacola's Veterans Memorial Park, on Bay Boulevard and was open to everyone. The festivities began by the presentation of meritorious awards of various kinds, to service men and civilians alike. I recall eating a Bratwurst and chatting with a lady whose son had just returned from the gulf. She had tears in her eyes as she spoke proudly of him and verbally thanked God for his safe return. He spotted her, waved and made his way through the crowd to her side. She introduced him to my son and me. The two boys immediately it off and excused themselves and headed to the beer tent.

Battles are fought by young men and women, but for the most part are started by old men. I, like many others through the ages, have wondered how many wars we would have if the situation was reversed and old men fought the wars instead of the young. It would indeed be interesting if those who initiated those conflicts were obligated to put on a uniform and fight along side those they've sent in harm's way. We'd probably have very few wars.

The Pensacola Symphony Orchestra had now taken the stage and was warming up. The crowd, larger than ever, quieted down as the musicians began the program with a brisk "Stars and Stripes forever!" John Philip Sousa would have been proud. The band and music seemed to last only a few minutes before the conductor announced that as a finale, they would play Tchaikovsky's "1812" overture.

Having been in the band both in high school and college, this was one of my favorite works by the old master, even though according to musical historians, he didn't much like the way this great piece of music turned out. While it was written as a tribute to the Russian army for stopping the French led by Napoleon in a battle that occurred outside Moscow in 1812, it's now played at many Independence Day celebrations here in the United States.

This was to be no ordinary performance. The overture as written was to have cannon shots and cymbals crashing, depicting both the French and Russian armies fighting with swords and firepower. The fireworks barge out in the bay provided that accompaniment!

This was the first time I had seen a synchronized pyrotechnics computer program linked to the "1812 Overture", though I understand it's done quite often today. Gigantic rockets were sent up with resounding booms and crashes as if cannons were blasting from just over the next hill. The clanging of symbols, ringing of bells and blaring of horns represented the joy and happiness of the Russian people cheering their soldiers that had stopped the French invasion of their country!

As each intricate part of the music was played, the fireworks exploded with perfect timing. For such a memorable and boisterous piece of music, the crowd was strangely silent as the last strain of music was played and the last rocket made its way to the heavens.

The concert ended and I looked around for my son. He and the soldier he had met earlier were sitting on a bench together, somberly looking out over the bay, no doubt reliving the sounds of battle from their own overture.

Professional Uses Of GPS Systems

There are many professional uses for GPS systems. Some are simple, such as using a GPS system to find a worksite before it is actually surveyed. Others are more interesting. One is the GPS Compass. A pair of GPS systems can accurately determine direction without worrying about magnetic declination, as magnetic north can be slightly different than true north in some parts of the world.

Weather Reports Another professional use for GPS systems is to increase accuracy for weather reports, with special systems able to determine information such as air density, temperature, moisture and electron density. This information can be fed into computer models in an attempt to increase the accuracy of the system.

Emergency Services

Perhaps the most dramatic uses are for emergency services. Both in terms of calling in locations when initially reporting the issue and aiding first responders to quickly find the location afterwards. E911 requires that all mobile phones be locatable by GPS, though not all parts of the US are E911 compliant at this time. GPS location is actually less power hungry than the radiolocation system which was the previous standard while increasing the accuracy.

Digital Cameras

Some digital cameras can be connected to GPS systems and insert the datetime group and location into the picture, useful when there is reason to desire pictures to be tied to a specific time and place, such as pictures of work sites or crime scenes.

Some tasks require precise timing and are connected to GPS systems, not for location but for timing. The systems are self correcting to ensure the GPS itself requires very accurate time in order to function, and there is no reason for other devices not to take advantage. So some devices such as seismology sensors which are in known locations have an integral GPS in order to keep that accurate time.

Surveying

Surveying is also becoming a GPS dominated function, with Survey quality GPS systems used to place survey markers, roads and buildings. Mapping quality GPS systems are used to keep accurate locations down to 10cm. Geophysicists and geologists use GPS systems to record locations in realtime, which can be of exceptional value in circumstances such as a volcanic eruption, a sinkhole or other rapid movement.

Military The original intended use for the GPS system was military, and the armed forces are still heavy users of the technology. The systems are so popular that some soldiers who are not assigned a GPS system will buy a civilian system for the added convenience of having one at any time it might be needed.

Navigation

Boats and ships make exceptional use of GPS systems. From knowing where they are on the chart to quickly reporting the location of a crisis such as a ship in distress or man overboard, a working GPS system turns navigation from a task requiring an extensively trained professional to a task that can be accomplished quickly by an amateur. This does not mean it isnt a good plan to have such a trained professional handy, of course.

Aromatherapy History

Aromatherapy is derived from two words: Aroma - meaning fragrance or smell; and Therapy - meaning treatment.

The use of Aromatherapy can be traced back to nearly 3000 years before Christ. At that time the ancient Egyptians used the basics of Aromatherapy in their daily lives. Historical records show that Egyptians burned incense made from aromatic woods and other herbs to honor their gods.

Aromatherapy also was used for healing and therapeutic practices. Medicinal plants are used to cure many ailments and used in many sacred rituals to evoke different states of consciousness.

Elaborate religious ceremonies were performed in Egyptian temples, where the dead King was mummified and surrounded with exotic essential oils. Egyptians believed very firmly that essential oils have an unusual preserving property when added with other spices.

Embalming was one of the principal uses of aromatherapy, preserving the tissue of the bodies for thousands of years. The oils and resins used were so potent, that in the 17th century mummies were sold in Europe and doctors distilled them for use in their medicines.

Priestesses and priests strictly supervised the delicate preparations in the temples and palaces, reading formulas & chanting incantations and hymns, as substances were measured & combined with ultimate precision. Purification processes went on for months until the right, perfect subtle blend was achieved. The use of aromatherapy spread from Egypt to Israel, China, India and the Mediterranean. Every culture, from the most backward to the most modern, developed own set of practices.

The Chinese may have been one of the first cultures to use aromatic plants for well-being. Their practices involved burning incense to help create harmony and balance.

The Greeks learned a great deal from the Egyptians, but Greek mythology apparently credits the gift and knowledge of perfumes to the gods. The Greeks also recognized the medicinal and aromatic benefits of plants. Hippocrates, commonly called the "father of medicine" practiced fumigations for both aromatic and medicinal benefit. A Greek perfumer by the name of Megallus created a perfume called megaleion. Megaleion included myrrh in a fatty-oil base and served several purposes: (1) for its aroma, (2) for its anti-inflammatory properties towards the skin and (3) to heal wounds.

The Roman Empire built upon the knowledge of the Egyptians and Greeks. Discorides wrote a book called De Materia Medica that described the properties of approximately 500 plants. It is also reported that Discorides studied distillation. Distillation during this period, however, focused on extracting aromatic floral waters and not essential oils.

For many centuries essential oils were the only remedies for epidemic diseases and conditions. During the dreaded Black Plague, very few became ill, who in fact were associated with perfumeries and glove industries where these oils were in profuse use.

During the 19th century, with the development of modern science, all forms of herbal medicine disappeared until the 1920s, when French chemist Gatefosse revived the art, giving it the name Aromatherapy. India was one of the few countries where the tradition was never lost, Avurveda being the most ancient medical practice in the world today.

From the late 20th century and on into the 21st century, there is a growing resurgence to utilize more natural products including essential oils for therapeutic, cosmetic and aromatic benefit. The use of essential oils never ceased, but the scientific revolution minimized the popularity and use of essential oils in one's everyday life. Today's heightened awareness regarding the use of synthetics coupled with the increased availability of aromatherapy information within books and the Internet has refueled the use of essential oils for therapeutic, cosmetic, fragrant and spiritual use.

Defamation and Slander on the Internet

As social networking sites and internet blogs continue to increase in both popularity and use, the opportunities for defamatory and libelous actions increase proportionally. Defamation, sometimes called "defamation of character", is spoken or written words that falsely and negatively reflect on a living person's reputation. Slander is generally spoken defamation, while libel is written. Blogs or social networks in which defamatory statements are written or recorded present several potential sources of liability and recovery for the person whose character was defamed. In cases where the defamation is proved, damages are presumed and often enforced with liberality.

Operators of blogs are generally immune from liability for defamatory statements posted on their websites, as long as they did not contribute to the posting. In 2003, the Ninth Circuit Court of Appeals ruled that a listserv moderator and operator of a website which allegedly published defamatory statements provided by a third party was eligible for immunity under the Communications Decency Act (CDA). Batzel v. Smith, 2003 US App.LEXIS 12736 (9th Cir. 2003). However, if the online service provider plays an active role in soliciting information from users that leads to the defamatory act, the operator may not be protected by the safe harbor provisions of the CDA. In Carafano v. Metrosplash.com, Inc., a federal court ruled on the application of the safe harbor of the Communications Decency Act (CDA). The defendant in that case operated a matchmaking website known matchmaker.com. As part of its service, the defendant collected profiles of singles based on an extensive questionnaire. The plaintiff sued Metrosplash because of a false profile of her which an unknown user had posted to the website. The court ruled that by creating the extensive questionnaire, Metrosplash played an active role in developing the information that had been posted. Furthermore, the court ruled that Metrosplash was an information content provider and thus not eligible for the CDA's safe harbor provided to "interactive computer services." Carafano v. Metrosplash.com, Inc., Case No. CV 01-0018 DT (CWx) C.D. Cal. 2002) (subsequently reversed by appeals court). While operators of blogs and services are generally immune from such liability, the more active the service is with its members, the greater the likelihood of potential liability as a publisher of defamatory materials.

Another potential source of liability is the person who actually posted the defamatory materials. As with more general defamatory statements or materials, a poster can be held personally liable for anything posted which reflects falsely and negatively on a living persons reputation. Posting false and explicit claims regarding a person will generally be held as defamatory for purposes of liability. However, other issues arise concerning the anonymity of the person posting the information, and if known, the jurisdiction in which they are subject.

Jurisdictional issues may arise in situations where the poster had no reason to expect that the effect of the posting would be felt in a certain jurisdiction. However, in defamation cases jurisdictional disputes are liberally ruled upon in favor of the victim. In Griffis v. Luban, the Minnesota court of appeals ruled that Alabama had jurisdiction over a Minnesota defendant who posted defamatory messages on the Internet. The defendant repeatedly posted messages on an Internet newsgroup attacking the plaintiffs professional credentials. The plaintiff initially obtained a $25,000.00 default judgment in Alabama, which she was seeking to enforce in Minnesota. The Minnesota court ruled that the Alabama court had properly exercised jurisdiction because the effects of the messages were felt in Alabama and that the defendant should have expected that she would be sued there. An important factor in the ruling was that she had actual knowledge of the effect of the defamatory statements on the Defendant. Therefore, the Minnesota court enforced the $25,000.00 default judgment. Griffis v. Luban, 633 N.W. 2d 548 (Minn Ct. App. 2001).

However, there are cases where courts have refused to allow the exercise of personal jurisdiction based on defamatory statements. In a Pennsylvania case, the court refused to exercise jurisdiction over a New York defendant who had posted defamatory comments about a defendant on an offshore betting website. The court held that since the comments were not specifically directed at Pennsylvania, the court could not exercise personal jurisdiction over the defendant. English Sports Betting, Inc. v. Tostigan, C.A. No. 01-2202 (E.D. Pa. 2002).

The problems with bringing defamatory actions based on internet postings largely lie in proving that the defendant actually made the posting. If that connection can be made, a much stronger case can be presented and jurisdictional issues can be tackled. An attorney who is experienced in cyberlaw and internet cases can improve your chances in prevailing in any such case. Without the help of an attorney who can find and connect the evidence, most internet defamation cases will fail for lack of evidentiary sources and experience.
